Different Types of Bankruptcy Relief
Bankruptcy cases are referred to by the chapters that describe them. Chapter 7 bankruptcy also referred to as a “liquidation,” can be the appropriate insolvency vehicle for individual debtors or businesses. Chapter 13 is available only to individuals and sole proprietors and is referred to by some as the “individual’s reorganization.” Chapter 13 is particularly helpful and most often used by an individual or married couple who need to bring their mortgage current. It is also useful for people who cannot qualify for chapter 7 relief. Chapter 11 is most frequently used by business debtors but also is available to individuals whose debts do not fall under the chapter 13 debt limitations.
